Good News For Clergy Sexual Abuse Victims

Major sexual-abuse scandals involving priests, clergy, and others associated with churches and religious organizations have been well-publicized throughout the U.S. In August 2014, a Pennsylvania grand jury report revealed that more than 300 priests had engaged in ongoing abuse of more than 1,000 children over a 70-year period. In New Jersey, 188 priests and deacons who had abused children from as far back as the 1940s were identified by the State’s dioceses in February 2019.

These scandals got the attention of the American public as well as its legislators.

Both New Jersey and Pennsylvania have passed laws that enable more abuse victims to bring their predators to justice.

Under the new Pennsylvania law, victims may be allowed 2 years from a 2018 Grand Jury Report on PA clergy sexual abuse to file a claim against a diocese that covered up ongoing abuse by its clergy if the victim can show that he / she did not know of the coverup until the report’s release.

The new law in New Jersey, effective as of December 1, 2019, allows:

  • adult and child victims to file civil cases against abusers within 2 years from December 1, 2019
  • adult victims to file until the later of the date they reach 55 or 7 years after becoming aware of the harm they suffered
  • victims to sue institutions and people who enabled or covered up abuse

These important new laws will hold many more sexual predators accountable for their actions and reduce the chances of coverup by institutions that care more about their own reputations than the people they are harming.
